Judge blocks Arkansas law requiring parental OK for minors to create social media accounts

On April 03, 2023, a Federal Judge in Little Rock, Arkansas issued a temporary injunction against a new law that would have required parental consent for minors to create social media accounts – the first measure of its kind in the country. U.S. District Judge Timothy L. Brooks funded an injunction that NetChoice, a tech industry trade group whose members include TikTok, Facebook parent Meta, and X, formerly known as Twitter, had requested against the law. The Arkansas restriction was intended to take effect in September, but advocate groups have denounced it as a violation of users’ constitutional rights.

The law would have applied only to social media platforms generating more than $100 million in annual revenue, while specific services like LinkedIn, Google and YouTube were among the designated exceptions. With a provision of a $2,500 fine for each violation, encouragement to your online activities and tech companies to work towards improved safety and protections, this limitation was the promotion of an issue that has increasingly attracted widespread nationwide scrutiny. The Surgeon General Vivek Murthy was to be appreciated for his warning against potential harmful effects for children and teens presented on the mother sites.
