PepsiCo Sued By New York State Over Plastic Pollution

New York State Attorney General Letitia James recently filed a civil suit against PepsiCo, alleging that its unregulated use of single-use plastic harms the Buffalo River and constitutes a ‘public nuisance.’ According to a survey, PepsiCo’s plastic packaging and waste was found to be the biggest contributor to the Buffalo River’s plastic pollution, producing > triple the amount of other polluters.

With mounting problems such as microplastics detected in both human bodies and fish species, and health-related issues including early puberty in females, reduced sperm counts, altered functions of reproductive organs, obesity, altered sex-specific behaviors, and increased rates of some kinds of cancers, James is adamant about obtaining a financial penalty and compensatory fines against PepsiCo.

While the company has stated various commitments toward reducing plastic pollution, the suit has stipulated that action has yet to be sent and PepsiCo has still not opted for alternatives in the New York market, unlike programs initiated in other countries like Mexico and Germany which have provided refundable and returnable glass and plastic goods.
